Terms of Service

These Terms of Service ("Terms") govern your use of CardYard, an online marketplace for trading card game (TCG) singles, operated in Australia ("CardYard", "we", "us", "our"). By creating an account or using CardYard, you agree to these Terms.

1. About CardYard

CardYard is a marketplace that connects buyers and sellers of TCG singles (e.g. Magic: The Gathering, Pokémon, One Piece, Lorcana). We are a platform facilitator only. We are not a party to the sale contract between a buyer and a seller, and we do not take title to the items listed. All amounts are in Australian dollars (AUD).

2. Eligibility and accounts

  • You must be at least 18 years old and able to enter into a binding contract.
  • You must provide accurate, current and complete information when registering and keep it up to date.
  • You are responsible for keeping your login credentials secure and for all activity on your account. Notify us immediately of any unauthorised use.
  • One account per person unless we agree otherwise.

3. Buying

  • Listings describe the card, condition, finish, and price. You should review a listing and its photos carefully before purchasing.
  • When you place an order you make an offer to buy, which the seller accepts by completing the sale.
  • Payment is processed by our payment provider (Stripe). By paying, you authorise Stripe to charge your nominated payment method.
  • Prices are in AUD. Where GST applies it will be shown.

4. Selling

  • By listing an item you represent that you own it, are entitled to sell it, and that the description (including condition and authenticity) is accurate.
  • You set your price, sale type (Buy It Now, Auction, or Make an Offer) and delivery terms within the platform's options.
  • Sellers receive payouts to a connected bank account via Stripe Connect. Payouts require a completed Stripe onboarding. We may hold or delay payouts where required by law, our payment provider, or a dispute.
  • You are solely responsible for any GST, income tax or other obligations arising from your sales. If you are registered for GST, you are responsible for charging and remitting GST as applicable.
  • Prohibited items include counterfeit or unauthorised reproductions, stolen goods, and any item the sale of which is unlawful. We may remove listings and suspend accounts that breach this.

5. Auctions

  • Auctions use proxy (maximum) bidding. Your maximum is confidential; the system bids on your behalf only as needed up to your maximum.
  • A bid is a binding commitment. By placing a bid you agree to pay the final price if you are the winning bidder.
  • You may be required to have a valid payment method on file before you can bid.
  • Auctions may extend automatically when bids are placed close to the end time (anti-snipe). The listed end time may therefore change.
  • The winning bidder must complete payment for the item. Failure to pay may result in account suspension and the item being offered to the next bidder.

6. Offers

Where a seller accepts "Make an Offer", an offer is not binding until the seller accepts it. Once accepted, the offer becomes a binding sale at the agreed price.

7. Fees

  • We may charge fees for using the platform, disclosed at the time of listing or sale. Fees are in AUD and include GST where applicable.
  • Third-party fees (such as payment processing) may also apply and are shown at checkout or deducted from payouts.

8. Australian Consumer Law

  • Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded.
  • Because CardYard is a marketplace, the contract of sale is between buyer and seller. Where the seller is selling in the course of business, consumer guarantees may apply to that sale. Where a sale is a private (non-business) sale, consumer guarantees may not apply; we recommend you confirm with the seller before purchase.
  • Sellers must not engage in misleading or deceptive conduct, including in descriptions, photos, condition or authenticity.

9. Disclaimers and limitation of liability

  • CardYard is provided "as is". We do not guarantee that listings are accurate, that items are authentic, or that buyers or sellers will perform. We are not liable for the conduct of buyers or sellers, nor for the quality, safety or legality of items listed.
  • To the maximum extent permitted by law, our liability for any claim is limited to the fees you paid us in the 12 months preceding the claim.

10. Prohibited conduct

You must not use CardYard to: breach any law; infringe intellectual property; post false, misleading or defamatory content; manipulate auctions or prices (including shill bidding); harvest user data; or interfere with the operation of the platform.

11. Intellectual property

CardYard and its branding are our property. Sellers grant us a licence to use listing content (including photos) to operate and promote the marketplace.

12. Suspension and termination

We may suspend or terminate accounts that breach these Terms, at our discretion. You may close your account at any time. Obligations that survive termination include payment obligations and these Terms' liability provisions.

13. Changes

We may update these Terms from time to time. We will post the updated version with a revised date. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
